Noida Authority razes 14 illegal kiosks in front of Gardenia Gateway

Noida: A day after they were turned back empty handed, officials of Noida Authority, the land-owning agency, on Thursday razed 14 illegal kiosks in front of Gardenia Gateway, a highrise in Sector 75, Noida.

On Wednesday morning, the illegal kiosks were razed in presence of heavy police force deployment.

According to an eyewitness, the action was taken in full police protection as officials were not successful in performing the task on Tuesday. 

An official said that the action was initiated in compliance to an order issued by higher authority of the development authority. He said that further action would be taken to remove the illegal structure for turning them into a facility centre.

Earlier, residents of the society moved to Uttar Pradesh Real Estate Regulatory Authority (UP RERA) seeking relief from the authority over changes in the original building development plan.

They had complained that the area was originally planned for the development of a community centre and swimming pool. It was then converted into commercial outlets. The developer was also trying to sell them to individuals, despite strong opposition from residents.

Rakesh Kumaria, the complainant said that they had filed 140 cases in UP RERA against the builder of Gardenia Gateway at plot no 9 in Sector 75, Noida. These cases were for obtaining OC/CC and then the registration of our flats in the society. 

He further said that the builder had also constructed the illegal commercial area in place of our facilities like community hall and swimming pool etc.

He said, “We have been living in the society for the past 5 years. But we don't have any space for recreation as the areas originally earmarked for the same were used as a commercial space.”

UP RERA had passed the order in our favour in July and August 2020 this year. It instructed the builder to get the registration of flats done by December 31, 2020. It also ordered Noida Authority to take action against the builder for development of commercial areas illegally.

The residents went ahead with a copy of order to Noida Authority on September 7, 2020 and urged Ritu Maheshwari, Chief Executive Officer of the authority to take necessary action.

She promptly ordered her official to initiate actions against the illegal kiosks and construction in the society and ensure that illegal occupancy is removed in compliance to RERA. Following it, the action was initiated.

Kumaria said that he has been informed that further action would be taken to restore the community hall by carrying out modifications in the structure of the commercial area.
