They moved Allahabad High Court, saying Sunworld had violated the Authority-sanctioned plan and constructed extra floors illegally to make more money out of the project.

Flat buyers in Sunworld Vanalika in Sector 107 of Noida, a project by Sunworld Developers Pvt Ltd, have moved Allahabad High Court against the builder. The petition says the builder has constructed illegal floors in the society in contravention to the laws laid down by Noida Authority.

Buyers alleged that the builder had violated the sanctioned plan and constructed extra floors illegally to make more money out of the project. In place of the sanctioned 11 floors in towers 7, 8 and 9, the builder has constructed 16 floors. Also, in place of the sanctioned 11 floors in towers 10, 11 and 12, the builder has constructed 18 floors.

Atul Aggarwal, a buyer, told City Spidey that last year on July 5, Noida Authority sent a notice to the builder to demolish the illegal floors within a week. The notice clearly stated that in case the builder failed to demolish the illegal floors, the Authority would carry out a demolition drive itself. However, neither did the builder pay heed to the notice, nor did Noida Authority make good on its threat.

When City Spidey contacted YK Gupta, director of Sunworld Devlopers Pvt Ltd, he said that after receiving the notice, he had met Noida Authority officials and submitted a written reply. The builder justified his stand by saying that as the land allotted to the project turned out to be insufficient, he had increased the number of floors in the existing towers. Gupta said that Noida Authority had understood the logic behind extra floors and even taken an extra amount to allow for it.
