In a development in the Eco Village 1 residential project, Noida , which may be of interest to many other house owners who are yet to get the possession of their residential flats, Uttar Pradesh Real Estate Regulatory Authority imposed a fine of rupees 3,95,600 on the Supertech limited. The fine has been imposed for non-compliance of RERA orders where there was a delay giving possession of flats to the house owners.

Manish Kumar, a home buyer of Supertech Eco Village 1 filed a case against the builder in 2018 and after the hearing on March 25, 2019, the builder shared that he will give possession of flats before December 2019. Kumar says, “During the hearing in RERA, the builder said that he will give possession in the month of December 2019. Following this  officials passed an order that till the date of possession, the monthly bank EMI’s of my flat need to be adjusted in the last payment.”

Manish Kumar booked his flat in the year 2010 and according to him, the builder had to give the possession till 2012. He booked his flat in tower C3. He shared that tower C3 doesn’t have the required certificates. The housing Society has approximately 3,200 residents and 57 towers. In seven of those towers, the possession has not started yet.

He added, “Builder did not obey the order of UPRERA. Neither he gave me possession nor the money was adjusted by him. In the next RERA meeting in 2020 it was proved that Supertech has defaulted RERA’s order. After eleven months, RERA imposed a penalty of Rs. 3,95,600.”

Manish Kumar shared a tweet, “क्या @UPRERAofficial भी @Supertechltd के  हाथों बिक गया? रु 282.76 करोड़ के परियोजना पर रेरा के आदेशों का  अनुपालन ना करने पर मात्र रु3,95,600/- का अर्थदण्ड। नियम तो परियोजना के  कुल लागत के 5% तक जुर्माना लगाने की छूट देता है। @myogiadityanath  @HardeepSPuri @PMOIndia @MoHUA_India.”

Many other flat owners have similar complaints. Sameer Bharadwaj, resident from tower C6 said,“I booked my flat in 2010 and the builder promised us that we will get possession in 2013, I took a loan from the LIC housing finance. In the year 2013, the tower was not completed by the builder, then he  promised us to give the possession in the year 2015, but there has been no development and now it is 2021. Finally I got my flat in the last month.”
