After the GDA fails to get all the pending development work done by the builder despite an earlier Allahabad High Court directive, the AOA takes legal recourse once again.

The AOA of Shipra Krishna Vista, a residential society in Indirapuram, has once again approached the court over pending development work to be carried out by Shipra Estate Limited, the realtor of the project.

The step was taken after the GDA failed to get the work done by the builder according to a previously passed Allahabad High Court directive.

The AOA confirmed that they had a cumulative requirement of around Rs 20-25 crore to complete all the development work.

Speaking to City Spidey, Arun Rai, president of Shipra Krishna Vista AOA, said,  "The society requires over Rs 2.5 crore for painting work; Rs 5 crore for 4,500 kVA DG system; Rs 1 crore for development work in tower F; Rs 25 lakh for service lifts in towers D and E; Rs 2 crore for the development of the clubhouse; and Rs 4.5 crore as sinking fund."

"We also demand the payback of the maintenance charges, amounting to Rs 9 crore. Besides, we must also be compensated for suffering at the hands of the builder for nine long years," Rai added.

The AOA had earlier filed a case with the Allahabad High Court in October 2015. In response, the court had deemed the GDA vice-chairman as the competent authority to sort out the issues by February 2016.

After that, the VC conducted several meetings with the builder and the AOA members till August 2016. Finally, the GDA passed an order on September 7, 2016, directing the builder to complete all the pending work and provide a plan of action.

However, though the order was passed on September 7, it mentioned prior commencement dates, as had been discussed during the many meetings.  

It said work for lifts in towers D and E would commence on August 1 (to be completed by September 30); painting work of all the towers to be started by September 1 and completed by 30th of the same month; electrical and plumbing work in tower F to commence on May 10 and completed by October 30; work on the clubhouse to be completed by July 30; and parking issues to be sorted by December 15.

Only work on the sinking fund and the DG set could be completed by March 31, 2017.

But despite orders from the GDA, residents allege, that none of the development works have commenced so far.

Furthermore, the AOA members allege that the GDA passed the orders despite their objections and without conducting a scrutiny of the site. "So we were forced to approach the court once again," complained a member.

Responding to the residents' demands, the court has now ordered the GDA to show how far the order passed on September 7 has been adhered to. It has also asked the GDA to furnish details. 

The case will come up for hearing again on February 9.
