In a rare incident, residents of ATS Advantage, an Indirapuram society, have filed an RTI to obtain the minutes of a meeting and the official copy of an order supposedly passed by the Deputy Registrar, Meerut.

In an order passed on October 15, 2016, the Deputy Registrar had stripped the AOA of some of its rights, such as conducting meetings and carrying out hefty financial transactions in the society.

Following this, the Deputy Registrar had passed another order on November 11, 2016, for alleged violations of the October order and called the AOA members for a meeting later in the month. AOA members of the society said the Deputy Registrar at the meeting, on November 28, had revoked his earlier order and empowered them to function as a regular AOA once more. 

An AOA member, however, said they could not continue as the society's resident body, as the Deputy Registrar's office was yet to send them a formal order, making the AOA's status official. 

They also said the Deputy Registrar's order dated October 15, 2016, violated the UP Apartment Act, 2010, which did not allow an AOA to be stripped of its rights before completing its tenure. This would have happened on December 12, 2016.

The RTI filed by the residents comprises the following demands:

1. It asks for a copy of the order and the minutes of the November 28 meeting, along with the letter number (in case they were already sent via post).

2. A clarification on how the Deputy Registrar could strip the AOA of its rights before it had completed its tenure.

3. A copy of the sections of the UP Apartment Act, 2010, which empowers the Deputy Registrar to stop an AOA from conducting general body meetings in the society.

Meanwhile, residents and AOA members await a quick response to the RTI query so they can streamline their activities and conduct resident meetings for fresh elections.
