FedAOA threatens to file contempt petition against GDA

FedAOA, the apex body of Ghaziabad apartment owners associations, has threatened to file a contempt petition against Ghaziabad Development Authority (GDA), if repair work on sewer lines in Ahinsa Khand II does not pick up pace after the state elections.

Residents had approached Allahabad High Court with a writ petition in February 2016, to which the court had passed an order directing GDA to sort out the issue of sewer lines in Indirapuram. Following the court's order, residents had formed a five-member committee to assist GDA in addressing the issue. Residents, however, said little had been done by GDA in a year after the HC order, with choked sewer lines still a major problem in societies. Recently, GDA officials had said that all major development work would be kept on hold till the state elections were over.

Speaking to City Spidey, Alok Kumar, founding member of FedAOA, said civic authorities nowadays seldom treated judicial orders with deference. 

"We are holding back the petition keeping the elections in mind," said Kumar. "But once the elections are over, we will not tolerate their inaction any longer." 

This is not the first time FedAOA has filed contempt petitions to get problems sorted. The federation had filed a PIL in 2012 to obtain DODs (Deeds of Declaration) for three Indirapuram societies. In 2014, the group had filed another contempt petition regarding the collection of sewer and water charges by GDA. The issue is still pending and is yet to be resolved by the court.

Apart from these, FedAOA has filed several other public interest litigations and contempt petitions against other government offices. Some of the issues have been resolved, while others are yet to be addressed.
