Residents of Shipra Krishna Vista, a society in Indirapuram, have alleged discrepancies in the functioning of the society’s AOA and also misuse of funds collected from residents.

Amit Agarwal, a resident of Shipra Krishna Vista, told City Spidey that the AOA had continued functioning, even though the validity of its registration was over on January 21, 2016. “This renders the AOA an unregistered body, so it also invalidates all its actions and decisions,” added Agarwal.

Agarwal also alleged that the AOA members were usurping the society funds, saying it required the money for legal proceedings against the builder. He said the AOA had approved an amount of 0.15 paise per sq ft per flat in a special general meeting of the society, but later, in the minutes of the meeting, claimed the agreed amount was Rs 0.15 per sq ft per flat.   

“This is a hundred times increase in the original amount approved by the residents. There’s a huge difference between 0.15 paise and Rs 0.15. While the former refers to 0.15 part of a paisa, the latter means 15 paise,” explained Sunil Pandey, another resident.

According to residents, the AOA members had wrongfully initiated the election process without consulting the residents. It finished its term on February 15, and set the new date for elections on April 2. "What is the point of conducting elections a month after the completion of its term?” asked Agarwal. “Moreover, they were only conducting elections for a third of the AOA body, which goes against the provisions of the UP Apartment Act, 2010,” he added.

City Spidey took up the issue with Deepak Sethi, the AOA general secretary. Sethi refuted all the claims and allegations, and said the process of renewing the registration of the body was set in motion on January 22, 2016, and that they received the registration certificate recently this year. "We have completed all the formalities, and recently received the renewal certificate from the deputy registrar," iterated Sethi.

Speaking about the confusion between 0.15 paise and Rs 0.15, Sethi clarified that the AOA asked for a contribution of Rs 0.15 per sq ft per month to cover the cost of fighting a case against the builder at the Allahabad High Court. “For every hearing in the court, we have to bear a cost of about Rs 1.15 lakh — the next one is slated for March 27. We have not had any objections so far,” said Sethi.

On the subject of conducting elections for a third of the AOA body, Sethi said the decision was taken while adhering to the by-laws of the UP Apartment Act, 2010. “We initiated the election process before the end of our term, and took the decision after consulting the Federation of AOAs. That’s how it’s done in other societies as well,” he explained.
