Will FedAOA succeed in shutting down AOAFed Ghaziabad?

Conflict of interest between apex bodies of AOAs in Ghaziabad has escalated to a new high as the Deputy Registrar's office issued threats to shut down AOAFederation Ghaziabad, a body of AoAs run by Colonel (Retd) TP Tyagi.

Following complaints filed by members of FedAOA, an older Ghaziabad AOA collective, the deputy registrar's office has ordered Tyagi, the president of AOAFed, to either rename the association by April 15 or respond with a valid reason why AOAFed should not be declared null and void.

The dispute between AOAFed and FedAOA arose from the similarity in their names, despite the latter being around for some time when AOAFed was formed. FedAoA members also accused Tyagi's organisation of being an impostor and also trying to bag limelight in violation of the provisions of the UP Apartmant Act, 2014, and the Societies Registration Act, 1860. Members of FedAoA approached Allahabad High Court with the matter in November 2016. In response, the court then referred the issue to the Deputy Registrar, Meerut, for resolution.

In the letter addressed to Tyagi, the deputy registrar's office accused him of concealing facts and attempting to mislead the office. The letter also says that Tyagi had hidden the information to get his federation registered.

However, while speaking to City Spidey, TP Tyagi stuck to his original claim that at the time of registration, he had requested that the name of the body be "RWA and AOA Federation Ghaziabad" but the Deputy Registrar's office had issued the name AOA Federation Ghaziabad.

Tyagi further declared the order a sham and misuse of power. However, Tyagi maintained that he will conform to the order and refused to further challenge it. "What's in a name?" said Tyagi. "We will offer a set of names to the deputy registrar and he can choose any one. Only the actions matter. We have been involved in pro-social activities for a long time and if people have any problem with the name of the body, we might as well change it."

Speaking to City Spidey, DK Maurya, president of FedAoA, the complainant body, said the order passed by deputy registrar's office serves the purpose only partially. Maurya further explained that the deputy registrar's office had only acted on the fact that the bodies had similar names while it completely missed out on the fact that Tyagi could not form a second federation of Apartment Owners Associations as he himself was not a part of any AOA and also did not live in an apartment.

"We are going to approach the deputy registrar's office once again," Maurya added.
