After Grand Omaxe, a residential society in Sector 93B, Noida, managed to form its own AOA a few months ago, there’s a fresh spat between the builder and the resident body over the handover of the common area and its maintenance.

The AOA has alleged that the builder is not giving them access to the electricity- and the maintenance-billing software of the society.

The builder, on the other hand, is insisting that it is being forced by the residents to hand over the society in a rush.  

The AOA has lodged a complaint with Noida Authority against Omaxe Buildhome Pvt Ltd, the developer, stating that the realtor is delaying the smooth transition of society assets to the resident body.

PVS Prakash, RWA secretary, explained, “The builder is not giving us the login ID and passwords of the billing software, which contains the balance sheets of the maintenance of the entire society. This restriction has other implications too. Suppose a resident wants to check how much he owes to the builder, he won’t be able to do so, as the software is password-protected.”

The complaint prompted Noida Authority officials to intervene.

In a letter to Rohtas Goel, chief managing director of Omaxe, additional CEO of Noida Authority Shishir Singh asked the builder to comply with Sections 14 (5) and (6) of the UP Apartment Act, 2010. It stipulates that the builder "has to" hand over the society and make available all data related to prepaid billing meters to the AOA. 

In the letter, Singh further said that it was the responsibility of the builder to comply with the order and inform the progress made to his office.
