The National Consumer Disputes Redressal Commission said during a hearing that the builder would have to inform the commission before selling the cancelled flats to any third party.

The National Consumer Disputes Redressal Commission (NCDRC) put a stay order on the decision under which the builder of Palm Olympia, a residential project in Sector 16C, Greater Noida (West), had canceled the booking of those homebuyers who had approached the commission against the builder in 2012.

On April 22, 2017, the builder canceled bookings of 35 buyers arguing that these buyers had not paid the dues despite several notices.

During the hearing on May 12, justice VK Jain said that the builder would have to inform the commission before reselling the canceled flats to any third party. The next hearing is scheduled on September 14. 

In 2012, the buyers had complained to the commission that they had paid 95 per cent of their flat’s cost, but the builder was demanding interest for zero period. Zero period is time during which construction of a project remains suspended due to some reason.

Ajay Kumar, a homebuyer, told City Spidey, “We have urged the commission to allow us to file an amended complaint as the builder has canceled our booking. The commission has accepted our request.”

Shweta Bharti, general secretary of Noida Extension Flat Owners Welfare Association (NEFOWA), welcomed the commission’s decision and said that it has come as a big relief to those buyers whose bookings were canceled.
