On hearing the plea of residents of Shipra Krishna Vista, an Indirapuram society, over issues of incomplete amenities if the society on Monday, the Allahabad High Court rapped both Ghaziabad Development Authority (GDA) and Shipra Estate Limited and asked both to come up with a response in the next hearing of the case.

The AOA had presented before the court that the builder had deviated from the approved plan by omitting some features and modifying others.

Speaking to City Spidey, Arun Rai, president of the society’s AOA, said that according to the original layout plan, there was a central park in the society but the builder had lifted the park a floor above the ground and created parking space under it. The builder sold the parking lot beneath the lawn and made profits.

According to the AOA members, the court has asked them to decide on the future of the park-cum-parking — whether to demolish the parking or continue with it. The court has also sought answers from GDA in the case. The case is scheduled for its next hearing on July 30.

Arun Rai further told City Spidey that the original plan of the project included a primary school, which was not constructed. He said the builder had to complete the project in 2008, and the completion certificate was to be issued. However, an application was made for partial completion certificate by the builder and it was issued by GDA. He also said that according to the response to an RTI query, full completion was to be issued once the school was built in the compound. But neither the school was built, nor the full completion certificate ever issued.

Residents said little work had been done on behalf of Shipra Group to provide painting, lift and generator sets since 2008 and the builder recently initiated work only after the court mounted pressure. The work of painting and installation lifts is underway, but residents are not satisfied with it.

Rai further said that the builder had also returned the money of the sinking fund but without paying any interest on it. “We refused to accept the fund without the interest amount while other development work was also pending,” Rai added.

The RWA president said the builder was to develop the society in collaboration with GDA. According to the MoU signed between GDA and Shipra group, GDA was supposed to monitor the work. “A committee should have been formed to monitor the quality of work. However, nothing like this happened which led to poor quality work,” Rai said.

On being contacted, representatives of Shipra Group said they would issue a statement over the issues only after receiving the official copy of the court’s order.
