Deputy Registrar Societies rules in a case of expulsion of RWA members of Sector 47, Noida, that the RWA violated by-laws. Demolition of unauthorised structures by Noida Authority on court’s orders cannot be the basis for expulsion.

Two RWA members, Omvir Singh Chaudhary and Prem Prakash Singh Bisht of Sector 47, Noida, were expelled from the resident body not too long back. 

Krishna Kumar Gupta, Deputy Registrar Societies, Meerut, said that the expulsion was not in accordance to the registered by-laws of the RWA constitution.

The registrar said that a public interest litigation filed by the complainant Prem Prakash in the Allahabad High Court against “certain unauthorised constructions” in the sector cannot be the basis of his removal from the RWA executive body. The “unauthorised structures” were demolished by Noida Authority on the court's directions, hence the complainants could not be held responsible for the demolition.

He stated that the RWA should have sent out information about the "Extra Ordinary General Body" (EGBM) meeting, which was held on August 23, 2015, at least 15 days in advance. The proposal for their expulsion should also have been included in the meeting’s agenda.

He added that the complainants were neither issued a showcause notice, nor given a chance to defend themselves.

Gupta told City Spidey, “I have received numerous complaints in which the membership of elected representatives had been suspended by their respective RWAs. Each case is heard separately and verdict is announced on the merits of a particular case.”

“The RWAs have to abide by the verdict of the Deputy Registrar of Societies. Non-compliance with the order can lead to cancellation of the RWA's registration,” he added.
