On what basis is Logix Blossom Greens asking for an occupancy certificate?

More than 50 homebuyers of Logix Blossom Greens, an incomplete residential complex, situated in Sector 143 near the Greater Noida Expressway, had staged a protest today against delayed possession outside the office of the Noida Authority in Sector 6.

The homebuyers have been persistently requesting the authority to reject the developer's application for an occupancy certificate.

The flash cards, banners and slogans hurled at the authority and the developer allege that the two are hand in glove. Incidentally, the authority has not initiated any action against the developer.

Manish Arora, who booked a flat in Logix Blossom Greens in 2010, said that the builder had applied for an occupancy certificate to keep the housing project out of the ambit of the Real Estate Regulatory Authority (RERA).

In Arora's words, "We have been pressuring the authority to reject the developer's application since 2014. If it is not rejected and the certificate is granted, the projects will be considered complete. Consequently, the builder will not have to  register the project with RERA.”

Several buyers have said that the developer has already started offering possession, despite the fact that the occupancy certificate is yet to come through.

Because the developer had assured possession in 2012, some families have not questioned him and accepted the offers. However, this is illegal.

Arora said, “The authority has cancelled the applications for obtaining water and sewer connection. However, it is yet to cancel the application for an occupancy certificate. People who took possession from the developer are also in trouble, as they have to pay inflated bills for power supply by DG sets."

In the course of the protest, buyers have urged the security personnel of the authority to allow them entry into the office. But they were prohibited entry at the gate and were told that senior officials were not present.
