Noida: Deputy registrar revokes residents’ body registration

Going ahead with its earlier show-cause notice that was challenged by residents’ body in the Allahabad High Court, the deputy registrar, firm and society, Meerut, has recently cancelled the registration of Grihapravesh Condominium Association, a residents’ body of Grihapravesh, a residential complex in Sector 77, Noida.

Through a letter, the deputy registrar has said that the association in question had not followed the bye-laws while it was being formed a few months ago. It further said the association has been given sufficient time to furnish the details to convince the deputy registrar's office to allow the association to continue. Due to this, registration of the association now stands cancelled. 

Members of the association in question told City Spidey that the deputy registrar's office took the decision in haste. They said they could have been given few more days for producing copy of the high court order before them. 

Navin Kumar, a member of the association and a lawyer by profession, said they had informed the deputy registrar's office via a letter that the court had quashed its show cause notice. He said, “We could not submit the copy of the order as it took time to get an update on the high court website. But we had informed that we moved the high court against the served notice. Still registration was annulled which is a matter of contempt of court. I will file this with the high court against the cancellation of registration.” 

On receiving show-cause notice, members of the association had moved a writ petition in the Allahabad High Court against the notice. Justice Mahesh Chandra Tripathi heard the case and ordered that the notice given by deputy registrar must have precise case set up against the society, which it has to meet and it should also contain statement of imputation detailing out the alleged breaches and default, the society has committed so that it gets an opportunity to rebut the same. But in the present matter, these are missing in the show-cause notice due to which is set a side.

The objections pointed out by deputy registrar were removed and the association was given certificate on May 16.

Another group of 38 residents demanded cancellation of registration of Grihapravesh Condominium Association on June 20

Grihapravesh buildtek Pvt Ltd sent mail on June 25 informing apartment owners that a meeting had been scheduled on June 26 for formation of apartment owner association. 

Adhoc committee comprising of ten office bearers was constituted on June 26 for the formation of apartment owners association. 

In response to its opponent, the Grihapravesh Condominium Association on July 7 submitted a replay with the deputy registrar. 

It on July 10 urged the deputy registrar not to allow formation of second association. 

One of the opponents namely Rajesh Kumar filed objection against the registration in question.

The show-cause notice challenged in the Allahabad High Court on August 9.  

The Allahabad High Court Order came on August 10.

The deputy registrar canceled the registration of August 14.
