A petition moved by a builder against a notice served to it by the New Okhla Industrial Development Authority (NOIDA) has backfired on the builder.  

On hearing the petition, Allahabad High Court ruled that the notice served to the developer of Grihapravesh, a housing complex in Sector 77 in Noida, was in accordance with law and that the petitioner should comply with the notice. 

On July 4, NOIDA officials had served a notice to the builder to complete the development of a mechanical parking facility in the basement, which is essentially modelled on the lines of a multistorey parking system. NOIDA had warned the developer to not allow parking anywhere in the open within the society boundary. 

Interestingly, the approved outlay for the facility mentions a connecting bridge between two residential towers, which is not in place so far.

The notice served to the builder asked for the removal of an existing gate and mandated that it be brought to the place where it had been approved in the original layout of the project. The notice further stated that the barricading of the green areas in the society be removed. 

However, instead of complying with these directions, the developer moved Allahabad High Court against the notice. Ironically, the court ruled that the notice served to it was in accordance with the law and should be complied with.

The court has now set a period of four weeks for the developer to correct the structural flaws. The developer will also be required to apprise the authority of action reports. Further, the court order has said that the respondent authority, NOIDA, will be allowed to carry out an inspection of the site. If found that the developer has not taken corrective steps, illegal structures in the society will be demolished.
