Noida: There is no legal sanction for CAM charges at Windsor Court

Without acquiring a completion certificate, a developer cannot levy Common Area Maintenance (CAM) on the flat owners.

Residents of Windsor Court, a residential society in Noida Sector 78 of Noida are complaining that the developer has illegally demanded for Common Area Maintenance (CAM) charges. According to the rules of Noida Authority, builders cannot claim for CAM without acquiring the occupancy certificate (OC) and completion certificate (CC).

The developer has given illegal possession to around 100 families till date. Residents say that the basic facilities are not in place. There is no fire fighting system, sewer connection or club house. The developer has not even taken a proper connection for residential electricity and he is substituting with a temporary connection, which was sanctioned by PVVNL during construction.  

Pabitra Das, a resident of Windsor Park told City Spidey that the developer has demanded for CAM at the rate of Rs 1.75 per sqft. “The builder has installed post-paid meters in the flats. Despite the fact that CAM charges cannot be deducted through these metres, he has been demanding for it (CAM) through cash or cheque,” Das added.

Residents also fear that if they do not pay the CAM charges the developer might disconnect the electricity connection or stop the water supply.

“As per government rules, the builder cannot disconnect the facility under any circumstances or conditions,” JK Gupta, Chief Executive Engineer, UPPCL assured the residents.

When City Spidey tried to contact Sanjeev Srivastava, Managing Director of ASSTech, he chose to be unavailable.

Santosh Kumar, Officer on Special Duty (OSD), Noida Authority told City Spidey that they have not received any complaint regarding this matter. Kumar stated that if a complaint is registered, the developer will definitely be questioned on the issue. “CAM charges should be demanded only after taking the completion certificate,” he added.
