Noida Extension Flat Owners’ Welfare Association (NEFOWA), a homebuyers’ group, filed a writ petition in Allahabad High Court today against the Uttar Pradesh Real Estate Regulatory Act (UP RERA), as implemented in October 2016.

The petition raised objections to the dilution of the original RERA. Though the plea has been listed for hearing, a date has not been declared yet.

Abhishek Kumar, president of NEFOWA, told City Spidey that he primary objection was the change in the definition of ongoing projects in the UP RERA. “The Central RERA says that until possession in a project has started, it will be counted under ongoing projects. However, the state RERA changes this to the condition that if in a project the builder has already applied for a completion or an occupancy certificate, it will be no longer be excluded in the category of ongoing projects. Noida and Greater Noida authorities have even issued both certificates to some projects without proper inspection.”

“Besides,” he added, “the definition of common area has also been changed in and there is no late penalty of 10 per cent on the builder if the project is delayed.”

More than 2.5 lakh buyers in Noida and Greater Noida have not got flats in the past three to four years due to delays in completion of projects.

"The objective of RERA was to protect the interests of homebuyers, but key points ensuring this have been removed in the state RERA. We hope our interests will be protected by the high court," Kumar added.
