A public road for Amba G Residency and a private patio for Ashiana Greens?

A clash of interest brewing between residents of Ashiana Greens and Amba G Residency for the past many years today came to a head when GDA tried to clear an allegedly encroached road in Ahinsa Khand 2, Indirapuram. The two-lane road connects part of Ashiana Greens, a few plot houses and Amba G Residency to the main road of the residential area.

Part of one of the lanes was fenced off by the RWA of Ashiana Greens and being used as the approach road and as car parking space by about 30 flats of the society. This left only a single lane available for use by residents of Amba G Residency and the plot houses for their commute.

According to residents of Amba G Residency, the RWA of Ashiana Greens had closed part of the lane in 2009, and ever since, Amba G Residency has been trying to open it via various means.

“We have made several requests to the RWA to open it, but they have not done a thing. We then went to GDA with our complaints,” said KK Singh, RWA president of Amba G Residency. Singh further said that due to this it had made it difficult for residents to drive their vehicles on the road. “The single lane left open for commute cannot even accommodate two vehicles at the same time,” Singh added.

 

 

The GDA’s anti-encroachment team that reached the spot today faced resistance from Ashiana Greens and had to stop midway as RWA members of the society claimed there was litigation in place regarding the matter and that it was subjudice. “The Gautam Budh Nagar district court has put a stay on the matter and the road cannot be opened till the court passes the order to,” said Pankaj Rai, president of the Ashiana Greens AOA.

However, GDA officials said no relevant documents supporting the claim were furnished at the spot. “We are not aware of any such litigation and have asked them to furnish relevant documents at the GDA office tomorrow. If they do not do so, we will have our own legal cell investigate this,” said Dayanand Prasad, OSD, GDA.

“If the matter is really subjudice, we won’t conduct any drive to unblock the road. But if it isn't, things will proceed like any other anti-encroachment drive,” Prasad added.

Ishtiyak Ahmed, chief town planner of GDA. told City Spidey that there was little chance of any public road being "allotted" to a society. “The road is owned by GDA, not the society,” Ahmed said.
