As of now buyers are having to register on the basis of super area, which is costlier. This is despite the fact that the Real Estate Regulatory Act (RERA) that came into effect from May 1, 2016 mandates registry only on the basis of carpet area.
The flat buyers of Gautam Budh Nagar are unhappy with the UP Registration and Stamp Department for registering flats on the basis of super area and not carpet area.
Rashesh Purohit, founder member of NCR Homebuyer’s Association told City Spidey that last month he has complained on Jansunwayi that the registry should be done on the basis of carpet area. “However, I got a surprising reply that the Uttar Pradesh Government has not issued any such order to the registration and stamp department,” said Purohit. 
So what are the advantages of registering your apartment on the basis of carpet area? “The flat buyer will have to pay less stamp duty and the builder will not be able to cheat him/her in the name of ‘super area’. Moreover, the Real Estate Regulatory Act (RERA) that came into effect from May 1, 2016, mandates registry only on the basis of carpet area. Therefore this is also the legally correct procedure,” answers Purohit.
Speaking to City Spidey today, officials of the UP Stamp and Registration Department stated that they will soon discuss the matter with top officials in Lucknow.
Mukul Singhal, chairman of UP RERA said, “RERA is a central act formed for the benefit of homebuyers. We will have to accept it.”
However, SK Singh, DIG of the Stamp and Registration Department of Gautam Budh Nagar maintained that till date the state government has not issued any notification regarding RERA. Singh added that the home buyers must persist with the state government to issue this notification. “Only when it comes through can we start registering flats on the basis of carpet area and not super area,” Singh concluded.
