Emaar MGF fails to deliver Gurgaon villa on time, faces FIR

Hundreds of homebuyers have complained against the builder for not getting possession even months after the promised date. Yashpal Sachdeva, a resident of Greater Kailash II, New Delhi, decided to go ahead and lodge an FIR with Gurgaon police.

Gurgaon police registered an FIR against realty giant Emaar MGF for failing to deliver a villa within the stipulated time period of 36 months.

Yashpal Sachdeva, 75, a resident of Greater Kailash II in New Delhi, had booked a villa in Sector 65, Gurgaon, for Rs 2.1 crore in 2011. The builder had committed to completing the project in the next three years.

"I had booked the villa through a real estate consulting company called 'Honey Money' and paid Rs 74 lakh as booking amount in 2011," said Sachdeva. "But it has been five years now and Emaar MGF hasn't even started construction. They have cheated me."

Sachdeva told City Spidey that he tried to contact the Emaar MGF officials at their DLF Phase II office, but they didn't answer his calls. So he decided to lodge a complaint with the police.

"We transferred the case to the Economic Offence Wing [EOW], which found the claim to be true," said Hawa Singh, CPRO of Gurgaon Police. "Following EOW's recommendation, Gurgaon police has registered an FIR against the company under IPC sections 420 [cheating] and 406 [criminal breach of trust] at the DLF Phase II police station. Emaar MGF officials have been asked to come in for investigation."

Sachdeva is not alone in his plight. There are numerous complaints from homebuyers against the builder for non-completion of projects.
