Tired of inaction, Nitin Saxena lodged a police complaint against Unitech Limited and the officials of the department of town planning (DTP), alleging harassment.

Nitin Saxena had booked an apartment in a low-rise independent floor of Unitech Limited in Sector 49, Gurgaon, in 2009 — delivery of the apartment was due in 2012. But he is still without a home, but not without a voice. He lodged a police complaint at Sector 40 police station last week against Unitech Limited and the officials of the department of town planning (DTP), alleging harassment.

Why also the DTP? It is the responsibility of the DTP to help buyers get possession of their apartments, believes Saxena.

He won an appeal in the National Consumer Dispute Redressal Commission (NCDRC) over non-delivery of the flat. But, in his words, the developer is not complying with the commission’s orders. The developer is not paying him interest for the delay, nor has it adopted a proactive approach in completing the apartment.

The complainant also visited the corporate office of Unitech several times in the past three months, but to no avail. He even lodged complaint at the CM Window, an online grievance redress system.

Again nothing moved...  

The station house officer of Sector 40 police station, Sudhir Kumar, confirmed that they have registered a complaint of harassment. “The police will investigate his complaint and if his complaints are found genuine the police will lodge an FIR,” he said.

Saxena had moved the NCDRC, which had ordered the developer in December 2017 to offer possession of the flat after obtaining occupancy certificate by June 30, 2018. It had also ordered the developer to pay compensation to the buyer in the form of simple interest of 8 per cent on the amount paid by Saxena, for delay in offering possession.

“We paid the developer, and yet after a lapse of seven long years there is no sign of handing over our dream home by the developer. The developer and officials of DTP are flouting the norms,” lamented Saxena. 

Calls and texts sent to representatives of Unitech Limited went unanswered.
