Agitated over inaction on an FIR lodged against the builder, hundreds of Lotus Panache homebuyers protested outside the SSP office in Sector 14A on Saturday. They demanded immediate arrest of the builder.

The homebuyers also met Dr Ajay Pal Sharma, SSP of Gautam Budh Nagar over the arrest of 3C builder and requested him to look into the matter. The protest was spearheaded by Lotus Panache Flat Buyer Association. Lotus Panache is a residential project in Sector 110.

The flat buyers, who have invested their hard earned money in the mega project of more than 4,000 flats, arrived at the SSP office at 10 am.

Sushil Kumar, General Secretary, told City Spidey that they lodged the FIR against the builder under the Section of IPC 406 (Punishment for criminal breach of trust) and 420 (Cheating and dishonestly inducing delivery of property) on January 12 but no action has been taken from the police till date.

“It is also clear in the audit report of the Noida Authority that the 3C builder diverted the funds to other projects. So, on what basis he is free. We asked SSP to take action against the builder and arrest him immediately,” Kumar added.

According to the homebuyers, they booked their flats in 2009-10 and builder was supposed to give possession of the flats in 2012-13 but they are living in rented apartments till date.

“We have already given 95 per cent of the flat amount to the builder. Whenever we met the builder’s officials, they gave a new date of possession. But, they never meet the possession date,” said homebuyers.

“The builder is making 30 towers in the society and it includes more than 4,000 flats. So far, they had given delivery of flats in only 9 towers. Moreover, the Noida authority had issued the occupancy and completion certificate for only 6 towers. But, builder gave possession in 3 towers illegally,” Kumar said.

Kumar also said that the construction work was also stopped in the last two years. “We also filed a complaint on the national consumer forum and we also raised the issue to the Economic Offence Wing (EOW),” Kumar said.

Dr Ajay Pal Sharma, SSP of Gautam Budh Nagar told City Spidey that he will talk to investigation officer on this matter. Police are gathering the evidence and the investigation is still under process against the builder.
