Ahead of the RWA election, which is scheduled on August 12, around 300 flats owners in Parsvnath Exotica, a residential society in sector 53, are complaining that their names are not included in the voter's list. They have approached the district registrar of societies and firms to stay the election until the matter is resolved.

The residents said that they have not been able to participate in condominium resident's welfare association electoral process, despite paying the requisite membership fees. Yash Handa, a resident, and the complainant in the matter said, "Around 300 residents have been denied a participation or avail their voting rights, despite paying the requisite fee between Rs. 2.5 lakh to 3 lakh. I purchased the flat in 2014 and paid a fees to the association but have been denied my right to vote. We have not 0been able to participate in the last election as well."

According to the residents, Parsvnath Exotica houses 780 apartments, out of which 470 flats have occupation certificate while 200 are living without OC and a possession of about 110 is pending. 

The residents alleged that the Exotica Condominium owners association denied their right and maintain that the aggrieved residents are not eligible as they do not have occupancy certificates. Dhruv Sharma, another resident said, "There is no such law that mandates possession of OC as a prerequisite for participating in the electoral process. Many people have OC but have not signed conveyance deeds with the developer are being denied their membership right."

The residents informed that they have made several complaints with the district registrar of societies and firms and Haryana CM window last year which resulted in stay order on the election until their membership matter is resolved. However, On July 12, the RWA announced fresh elections for August for which a returning officer has been appointed by the district registrar. "It is a clear violation of the order, the matter is still pending. How can they announce election without resolving the matter," said Handa.

Meanwhile, IS Yadav, District registrar of societies and firms said, "I have a petition regarding the membership issue and we are looking into the matter and soon we will resolve it until then no election will be conducted."
