In a first of its kind direction, the Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) instructed as many as 25 homebuyers, who have booked their flats in three different projects of Supertech group – Cape Town, Ecovillage 1 and Ecovillage 3 – to pay up their dues to the builder within 45 days.

The regulatory authority warned homebuyers that failure to abide by its directive would cost them, dear. It contended that the developer had the right to deduct 15 per cent of the total amount paid for the flats. A bench of the RERA also warned the homebuyers that they could lose their flats if they failed to settle their dues on within the stipulated time.

A “non-preferable”, as the flat buyers call it, has come up in a complaint of Surpetech group alleging that the homebuyers are neither taking the delivery of their flats nor are they paying pending dues as per the builder-buyer agreement.

Officials in the UP-RERA too conceded that the direction issued to the flat buyers was uprecedented. “This order is the first of its kind and also shifts some responsibility to the buyers,” a UP-RERA member Balvinder Kumar was quoted as saying.

“We have made it clear in our order the buyers will have to turn up, pay their balance and take possession of their flats in 45 days, failing which the builder would have the right to deduct 15% of the total amount deposited with it and refund the balance to the investors’ bank accounts,” Kumar added.
