Giving strict instructions to police officials on dealing with mischievous elements in residential societies, the Gautam Budh Nagar District Magistrate, BN Singh, ordered issuance of muchalka.

Muchalka is a written agreement or bond taken from a miscreant to bind him with an oath not to create any nuisance in a society. 

Gautam Budh Nagar As per the order, a bond between Rs 5,000 and 5 lakh will be issued to both parties (or any number of parties) involved in creating nuisance and proceedings will be initiated against them depending on the kind of mischief they indulge in and its intensity.

People who served with muchalka have to appear before city magistrate within three days failing which a non-bailable warrant can be issued against them.

Lately, the societies are witness to several disputes prompting the administration to intervene and take measures to resolve them.

City Magistrate Shailendra Kumar Mishra said that most of these disputes take place in a society as elections are not conducted when they are due. Non-payment of electricity and maintenance charges and money transactions other major triggers for the disputes.

He said a law and order situation only arises when there is resistance among people. In the absence of solution, tensions are bound to escalate. And when they escalate, others who have nothing to do with the disputes too get affected. Without the intervention of the police and administration the tensions arising from such disputes cannot be eased. 

When a dispute intensifies, both sides complain to the police and the administration. Police investigation generally take longer than expected and in some cases the problem remains unresolved. The Noida and Greater Noida Authority also has many such cases with it pending resolution.

He said there are more than 15 such cases that he dealt with in the last few months.

The objective of issuing such order is to restrain people from unduly creating problems for others. Imposing fines like these will go a long way in instilling a sense of liability in the people, an official from the administration told CitySpidey.

An official from Bisrakh police station said, “At times, the situation turns so serious that if the police do not intervene, the situation can go out of hand.”

An official from another government department aired similar views when he told CitySpidey, “Such troublesome people only create anxiety among other residents. They do not want to highlight a problem but to take advantage and remain the centre of attention.”

A resident of Mahagun Moderne in Noida’s Sector 78 said, “We have a selected apartment owner association (AOA), not a constitutionally elected one. The residents, therefore, have every right to speak up against the injustice done to us.”

Of late, several societies across GB Nagar have either approached the police, authorities or administration to resolve their internal disputes.

The Noida and Greater Noida region of the district has turned into a hub of protest by the residents and homebuyers who indulge in it mostly on weekends. It has been often seen that a peaceful protest quite often takes an ugly turn with people resorting to blocking roads, sitting on dharna, encroaching roads etc. causing inconvenience to general public.
