It wrote to the Ghaziabad administration saying a delay in the voting process led to chaos in a society's management and disrupted the democratic nature of elections.

Taking into consideration the repeated clashes between the provisions of UP Apartment Act, 2010, and the implementation of Section 144 of CrPC in the district, AOA Federation Ghaziabad sent a letter to the Ghaziabad administration, requesting it to not postpone society elections.

Section 144 of CrPC, which prohibits the assembly of more than four people in an area, was imposed on the district by the district magistrate (DM) from December 25 to February 15 in view of the forthcoming state polls. According to the DM, society elections were generally barred during the period as a precautionary measure, as participants could be associated with major political parties and could push their personal political agenda through society elections.

Members of AOA Federation said this was disrupting the election process in Ghaziabad societies.

In the letter addressed to Nidhi Kesarwani, the district magistrate of Ghaziabad, AOA Federation mentioned that according to UP Apartment Act, 2010, the tenure of an AOA was one year. Not electing a new AOA body on time left the society headless. Thereafter, the responsibility of the election rested with the Deputy Registrar, for which residents had to make several rounds of the Deputy Registrar's office in Meerut. The Deputy Registrar then passed on the request to the district administration to hold elections.

This resulted in a chain of issues, which delayed the electoral process. This in turn created chaos in the society's management, along with disrupting the democratic nature of elections.

The letter also mentioned that in such a situation, getting an approval from the SDM also took time, which further added to the delay.

The members maintained that the district administration did not have a direct link with the society elections. While the UP Apartment Act, 2010, did not make mention of the district administration, it assigned responsibility to the Deputy Registrar, Meerut.

"In view of more than 300 societies in all of Ghaziabad, and to avoid trouble, we have requested the District Magistrate to not postpone elections," said TP Tyagi, president of AOA Federation Ghaziabad.
