FedAOA and AOAFed: These two have a genuine problem

Federation of AOAs (FedAOA) and AOA Federation (AOAFed), two resident bodies in Ghaziabad, are at loggerheads over which of the two is genuine. The dispute arose from the similarity in their names and also owing to the fact that one of them was already around when the other was formed.

Alok Kumar, patron of FedAOA, told City Spidey that FedAOA was formed in August 2014, according to the by-laws of UP Apartment Act, 2010; Colonel TP Tyagi, on the other hand, registered AOA Federation in January 2015.

Kumar maintained that only a resident of a high-rise society and member of a society's AOA could form a federation of AOAs. "Colonel TP Tyagi is neither a resident of any society, nor a member of any AOA. The name also violates the provisions of the Societies Registration Act, 1860, which bars any registration under a name which is identical with, or resembles, the name of any other association that has previously been registered or incorporated under the Act," he added.

Members of FedAOA approached Allahabad High Court with the matter in November 2016. In response, the court referred the issue to the Deputy Registrar, Meerut.

Speaking to City Spidey, Colonel Tyagi said that at the time of registration, he had requested that the name of the resident body be "RWA and AOA Federation Ghaziabad". However, he said, the Deputy Registrar's office issued them the name "AOA Federation".

"We are not responsible for the deputy registrar's decision," Colonel Tyagi added. "In fact, Ghaziabad Development Authority did not object to the name we had proposed." 

Colonel Tyagi said AOAFed had about three societies from each of the six zones in Ghaziabad under it, with 80-85 members in all.

"We have sent our clarifications to the Deputy Registrar's queries," Colonel Tyagi added.
