The meeting was held to address issues between the builder and residents of Grand Omaxe and Omaxe Forest Spa.
Residents of Grand Omaxe and Omaxe Forest Spa, both of them residential societies in Sector 93B, Noida, expressed displeasure over the tri-party meeting with the builder and Noida Authority. They said that the meeting was a waste of time as Rohtas Gupta, founder of Omaxe group, did not turn up for the meeting. The meeting was held at Indira Gandhi Kala Kendra on June 21.
Surya Prakash, general secretary of Grand Omaxe AOA, said, “There will not be any positive results due to the meeting as the decision maker from the builder’s side was absent. The meeting was a waste of time for residents and the Authority.”
Residents of both societies raised the common issue of pending registration of flats. They complained that they have paid the charge for stamp papers to the builder but the builder has not registered the properties with the registrar of department of stamp and duty. There are 300 unregistered flats in Grand Omaxe and 218 unregistered flats in Omaxe Forest Spa.
Residents of Grand Omaxe raised the issue of handover of the society from the builder. They claimed that the builder was not returning Rs 12 crore to the residents’ body, which is the amount deposited by residents with the builder as interest-free maintenance fund.
Umog Sethi, president of the residents’ body, demanded that the Authority direct the builder to prepare a snag list for completion of the handover process. He said, “The builder should give sanctioned copy of the project layout and other compliance certificates, such as environment clearance and NOC from the fire department.”
Sandeep Jain, a resident of Omaxe Forest Spa, said that the builder had not obtained completion certificates from Noida Authority due to which the registration of flats was being delayed. He also complained that the project was to be developed on eight acres of land but has come up on only seven acres. He alleged that the builder has developed another housing project on the remaining one acre of land.
Ashok Kumar Srivastava, additional CEO of the Authority, directed Mirtunjay Singh, who was representing the builder, to form a committee immediately for preparing the snag list so that the handover can take place after completion of the remaining work. He also suggested that the builder and residents conduct a meeting to discuss the clauses of the memorandum of understanding to be signed during the handover.
Singh assured the Authority that the preparation of snag list would begin from Monday and it will be completed within a week. He said that once both the builder and residents enter into agreement over the handover, the balance amount of the interest-free maintenance fund would be paid to the residents' body in instalments.
Singh added that the builder has applied for rescheduling the projects. If the Authority permits this, the registration of the remaining flats would also begin soon.
Noida Authority had allotted the builder plots in 2006 for the housing projects. The projects were to be completed within five years. But the builder had taken an extension of three years from the Authority later. The builder has also not cleared dues of Rs 206 crore due to which the Authority has not given it completion certificates.
