Noida Authority has recently decided to draw up a list of societies in which the builder is not handing over maintenance of common areas to the AOAs. Residents want to approach GDA with a similar demand.
Following in Noida Authority’s footsteps, AOAs in the city have asked Ghaziabad Development Authority to draw up a list of high-rises in which the builder is refusing to hand over maintenance of common areas to them.
Speaking to City Spidey, Alok Kumar, patron of Federation of Association of Apartment Owners, or FedAOA, said, “As per the amendments in the UP Apartment Act, 2010, in April 2017, a builder is liable to call the first general body meeting of residents to elect an AOA in a project that has the registries of 60 per cent of its flats done. Subsequently, the builder has to transfer the maintenance of common areas to the AOA. But most builders do not follow this process, so they can coerce money from residents. The AOAs and residents have to run after GDA with their problems.”
However, Kumar maintained that according to the UP Apartment Act, if a builder did not elect an AOA, the authority could step in as a mediator to hold the election. “GDA is trying to shirk these issues instead of addressing the problems of the AOAs,” Kumar added. “We have, on various accounts, approached GDA with our requests and will soon send a letter about this as well.”
