Unwilling to let go of the IFMS charges, several builders — in open violation of the Uttar Pradesh Apartments Act, 2010, guidelines — have retained control of common areas.

Elected AOAs of various societies in Noida are waiting for the builder to hand over society maintenance. AOA members have also demanded the transfer of Interest-Free Maintenance Service (IFMS) charges to AOAs.

In Noida, several builders have not transfer maintenance of common areas to AOAs, openly flouting provisions of the Uttar Pradesh Apartments Act, 2010. As a result, residents have been forced to pay hefty maintenance charges to builders in return for poor services.

When a buyer purchases a flat, a maintenance charge is paid to the builder. When an AOA is formed, the builder has to hand over the maintenance amount collected from buyers to the association — something that many builders are reluctant to do.

PVS Prakash, AOA secretary of Grand Omaxe in Sector 93B, said, “It has been six months since the AOA was formed, but the developer still refuses to hand over maintenance. The UP Apartments Act, 2010, clearly mandates the hand over the maintenance to AOA once the body is formed.”

He added, “On June 21, the Authority ordered the developer to hand over maintenance to the elected AOA, but the developer still hasn’t done so because it doesn't want to let go of its income. The builder is also not handing over the IFMS amount of Rs 12 crore. He has just transferred a crore of that amount.”

Gautam Kumar, AOA president of Griha Pravesh, said, “Formation of an AOA is necessary after 60 per cent occupancy. We are still waiting from the builder side to hand over maintenance. We also protested and took out a march, but the developer refuses to budge.”

In about 40 societies across Noida, the builder is refusing to hand over maintenance to elected AOAs.

But has Noida Authority shown any interest to resolve this impasse? Nope!
