The high court had issued a show cause notice to the Haryana government seeking an explanation as to why they should not be directed to constitute a new committee for reviewing the process of delimitation of wards.
The Punjab and Haryana high court has deferred the hearing of a civil writ case on the polls till November 7, pushing back Municipal Corporation of Gurugram (MCG) elections further back. The elections have been pending since June 2016.
The high court, on July 25, had issued a show cause notice to the Haryana government seeking an explanation as to why they should not be directed to constitute a new committee for reviewing the process of delimitation of wards.
The court’s notice was based on a civil petition filed by members of Qutub Enclave RWA of DLF Phase I; Bhup Singh, a resident of Tigra village; Rishi Raj Rana, a leader of Indian National Lok Dal (INLD); and Jile Singh, president of the Saraswati Vihar RWA. In the petition, the group challenged the demarcation order of municipal wards with regard to population figures, selection of areas in wards and representation in advisory committee.
During the hearing at Chandigarh on Tuesday, the state government representatives did not file a reply before the two-member bench of Justice Surya Kant and Sudhir Mittal.
The HC judges sought a reply from the state government representative and deferred the case until November 7.
Although the court has not deferred or stayed the elections, if the court directs the government to form an expert committee, elections cannot take place until the HC reviews the panel’s recommendations.
