Is the builder ignoring Mahagun Mansion's AOA?

Residents have been living in Mahagun Mansion Phase I, an Indirapuram society, since 2006. It has been a decade now and yet the society's AOA, formed in 2008, has not received its completion certificate and deed of declaration from the builder.

Several attempts by residents to meet Mahagun India's top management have fallen flat, with officials postponing meetings stating some reason or the other. Even after several years of handover, the builder has not formally transferred maintenance and other responsibilities to the AOA, which, residents say, is a means to coerce money from flatowners.

The AOA sent a mail addressed to the builder's top management, requesting them to hand over the documents. But that, too, hasn't worked.

As per the UP Apartment Act, 2010, after obtaining the completion certificate, the promoter is responsible for giving possession, along with the handover of all original documents concerning electricity, water, design details, architectural drawings, and NOCs from Jal Sansthan, the GDA, and the fire and electricity departments, to the AOA.

The AOA of Mahagun Mansion Phase I met representatives of FedAOA over the issue last week. In the meeting, it was decided that it would file an RTI to get hold of the required documents. Following this, an RTI query was filed on Monday.

City Spidey took up the matter with Rajeev Srivastava, general manager (marketing) of Mahagun India, who claimed he was unaware of the situation about the documents. But when asked about why several meetings with the AOA were postponed, he insisted he had had "friendly meetings" with AOA members. Srivastava, however, refrained from commenting on the status of the completion certificate and the deed of declaration.

Residents, however, did not buy the reply. Speaking to City Spidey, Milind Manasvi, head of the external affairs committee of the society, said that Shrivastava's reply was a blatant lie. "They pay no heed to our problem," added Manasvi.

Meanwhile, the AOA of the society awaits a reply to the RTI query.
