A group of homebuyers of 3C Lotus Boulevard and Espacia, Sector 100, Noida, on Saturday staged a protest outside the builder's office in Sector 127. They demanded the builder pay penalty for the delay in possession.
Jagdish Prashad, who booked a flat in 3C Lotus Espacia told City Spidey that the possession of flats had already been delayed by more than three years. The builder had promised to handover the keys by 2013. The society, however, is still nowhere near completion. The buyers are exasperated as the builder has refused to give a new deadline.
About 50 buyers reached the builder's office around 11 am and handed a memorandum to the service head of 3C Lotus Boulevard, Naveen Mann. Homebuyers also held placards and raised slogans against the builder.
Another homebuyer, Rajeev Nirjhawan, who has a flat in 3C Lotus Espacia, said that through the memorandum, the homebuyers demanded that the builder pay penalty to all homebuyers for the delay. He pointed out that if homebuyers do not pay the builders on time, they are charged 18 per cent interest. Nirjhawan said that they demanded the builder pay the same interest that they would have collected from homebuyers.
According to National Consumer Dispute Redressal Commission’s recent verdict, the developer is yet to justify if he was asking the homebuyers to pay super-area or common-area charges.
Rajesh Agarwal, who booked a flat at 3C Lotus Boulevard, said, that the builder is asking an extra Rs 7 to 13 lakh from homebuyers, claiming that the super areas of the flats had been increased by 200 to 225 sqm.
The increased area, however, is not visible. The builder has not explained where the super areas have been increased. This is a burden on homebuyers as they have to pay maintenance charges based on total area, which the builder has claimed, increased.
Service Head of 3C Lotus, Mann, will give the copy of memorandum to Vidhur Bhardwaj, Managing Director of Granite Gate Properties Private Limited, the parent company of 3C Lotus.
