Following a complaint by two residents of Prateek Laurel (Sector 120, Noida), the deputy registrar, Meerut (Trust and Society), observed that the current residents’ body conducted the election in violation of the rule under Section 25 (2) of the Society Registration Act 1860 and has written to the district magistrate, Noida, asking him to appoint an election commissioner for fresh AOA polls at Prateek Laurel.

According to Section 25 (2) of the Society Registration Act 1860, if the term of the AOA is over, the authority to conduct elections lies with the deputy registrar. Moreover, as per section 26 (1) of the by-laws, the annual general body meeting (AGM) of the association should be held in the first quarter of the financial year in which election commissioner for the fresh election is to be appointed. But, the outgoing AOA did not call the AGM before the due date. Instead, they held an election a month after the due date. 

Observing this, two residents of the society, SS Rawat and Atul Thakur, registered a complaint with Noida Authority that was forwarded to the deputy registrar, Meerut. In their complaint, they had informed the Authority that the association did not conduct elections as per the by-laws of the UP Apartment Act 2010, and that former AOA members were still holding the AOA office. Elections were held on March 15, 2015, and the term for the AOA formed then got over on March 14, 2016.

After hearing both the parties, the complainants and the members of the current AOA, the registrar observed the violation of Section 25 (2) of Society Registration Act 1860 and wrote to the district magistrate.

Expressing dissatisfaction over the verdict, Sandeep Singh, president of PLAOA told City Spidey, “The resident body was following the society by-laws that says AGM should be called in the first quarter of the financial year. But, it was the builder who conducted the first election in the last quarter of financial year on March 15, 2015. We could not call the AGM as most members were busy in registration of their properties with the registrar of stamp duty to avoid the new increased rate of 2 per cent in Noida.”
