The Supreme Court on Wednesday ruled that the office of Chief Justice of India (CJI) will come under the ambit of Right to Information Act (RTI Act).

During the hearing, the top court asked the information commissioner to apply test of proportionality while entertaining applications seeking information from CJI's office. They said that it should be done keeping in mind right to privacy and independence of judiciary.

The landmark judgment was given by five-judge constitution bench. The bench was headed by Chief Justice Ranjan Gogoi, who retires on November 17.

The apex court also emphasised that there must be a balance between right to information and right to privacy as well as confidentiality and independence of judiciary.

The SC also said that right to privacy and confidentiality is an important aspect and it has be balanced while giving information from the CJI's office.

In a separate judgment, Justice Chandrachud said that judiciary cannot function in total insulation as judges enjoy constitutional post and discharge public duty.
