Greater Noida: Homebuyers of Shri Radha Sky Gardens, Sector 16B, Greater Noida, have mounted a legal challenge against the builder for having delayed the possession. Around seven buyers of  Shri Radha Sky Gardens approached the Real Estate Regulatory Authority (RERA).

The aggrieved buyers said that they have almost given all the payments for their respective flats but are yet to receive possession. CitySpidey talked to the buyers who filed the complaint to RERA to understand their problem.

Vinod Sharma, an aggrieved buyer said that he had booked his flat in July 2018 which cost him around Rs 40 lakh. In order to purchase this flat, he took Rs 30 lakh as a loan. Sharma said, “Till now, I have paid more than Rs 20 lakh and the builder has received 95 per cent of the amount. When I booked my flat, the builder gave me the possession date in December 2018 and promised me that it will be delivered to me before the possession date. Now, more than 3 years have passed and there are no changes in the flat as well as the tower.”

“The lift is not there so it is very difficult to see my flat which is on the 10th floor. Apart from it, many things are getting worse day by day. I have used all my hard-earned money to take this flat. Today, I am also paying rent as well as a huge amount of EMI for the last 20 years. I am a private employee and in the pandemic, I also faced salary cuts and became jobless, but still, I paid EMI but cutting on essential expenditures like my son’s school fees and rent of my house for some months that I paid later but I did not stop paying bank EMI,” he said.

Another buyer, Sanjeev Dahara said that he had booked his flat in February 2013. But unfortunately, he is still waiting for it. Dahara said, “Approximately Rs 44.53 lakh payment has been paid by the end of 2014 by myself. Only the last payment at the time of possession is left. The owner of the SJP Infracon Ltd project had promised to hand over the possession by February 2016 as per the allotment letter dated 02-02-2016. I have paid hard-earned money and also taken a bank loan to pay the above amount. Unfortunately, the company has not given me the possession of the flat till date.”

He further said, “I have visited their office time and again, also given them many reminders for the possession but every time the authority says that the possession will be given after 6-8 months as soon as they will get Occupancy Certificate. I've been listening to these types of excuses for the last 6 years but all in vain. After the pandemic, where the world is going through a tough phase, middle-class people like us with private jobs are facing challenges and salary cuts, some of us have no source of income and still paying the bank EMI. The situation has put us in a deep state of depression.”

68 years old Surjeet Kanta who booked his flat in 2013 was assured by the builder that the possession will be handed over in June 2016. Kanta said, “Possession for towers 11, 15 and 17 has not been handed over so far. For our Tower 17, we have been chasing the builder for possession but the situation is very pathetic. The builder doesn't tell where our money has gone. Those who have got possession and are living there, have got multiple maintenance problems because the builder has not spent the money collected from buyers in their favour.”
