Antriksh Golf View 2: Cancellation of OC is hard on residents

The Noida Authority cancelled the Occupancy Certificate of Antriksh Golf View 2, a group housing highrise society, sector 78, Noida on February 4. Officials of the authority shared that the OC has been cancelled for violation of various building norms, including the construction of unauthorised commercial units and unauthorised parking slots in society.

Builder buyer issues in Noida and Greater Noida West are nothing new. The residents can be seen struggling with pending registry of their flats while some of them complain about inadequacy of basic amenities in the society. Moreover, some of the residents are living in societies that are still under construction, which means society doesn't have OC/CC (Occupancy Certificate/Completion Certifiate).

What does the OC mean?

OC certifies that the building has complied with all the required building standards, local laws and it is safe to occupy. Occupancy certificate is issued by local municipal authorities or building proposal department that provides no objection to occupying the building under reference for its specified use. The OC is issued only once the building has been completed in all respects and can be occupied. The legal possession of the flat by the owner is valid only with the Occupancy Certificate.

The Completion Certificate shows that the building construction is done as per the plan approved by the authorities concerned.  After the CC is issued, the OC is given to all buyers so that they can take possession of their flats/properties.

Brajesh Sharma, a resident of Antriksh Golf View 2 says, “For the builders, it is not easy to get hold of the CC because in most cases, builder has not completed the entire work of the construction of society. Due to this, residents take their complaints to the authority, in view of which, authority doesn’t pass the CC. Whereas, the builder, after showing the safety measures, gets OC from the authority. This allows residents to take possession of their flats without their registry papers.”

Sharma further says, "In our society, around 600 flat owners are struggling to get their registry papers. Authority has cancelled the OC and it has become even more difficult to get registry papers now. Though the authority has taken valid action against the builder, but they also should think about the residents who have spent their life's savings in buying these flats. We are thinking of talking to the CEO of the authority to get a better solution for us.”

Another resident Sunil P Singh says, “When authority issues OC, it validates that residents can live in this tower and society. In our society, the builder did not follow all the protocols, due to which the OC has been cancelled by the authority. But the authority should address all the major points with the builder as the cancellation of the OC is not in favor of the residents.”

He adds, “There are many residents who have taken to buy their flats. The banks ask for the registry papers which a lot of residents don't have. This leads to home loans being converted into personal loans and they have to pay extra interest.”
