DK Srivastava, a member of the former resident body of Prateek Laurel, a residential society in Sector 120, Noida, has registered a complaint with the Deputy Registrar, Society and Firms, Meerut, against the election procedure.

Srivastava has alleged that he was barred from contesting the elections on unfair grounds and that his nomination was cancelled without any prior notice. He stated that he had filled his nomination on June 22 and that his name was taken out from the final list of contestants that published by the returning officers on June 24.

Responding to the complaint, the deputy registrar has issued a letter to the sub-divisional magistrate of GB Nagar, stating that prima facie this was an issue of election arrangement and therefore not under his jurisdiction. Hence the matter has been transferred to the SDM’s office.

When contacted, Uday Jain, sitting secretary of the resident body, said that the issue was related to Clause 26 of the by-laws, according to which one third of the existing members of the executive board were required to retire every time the society went for fresh polls.

While two members had readily retired, Srivastava had refused. Therefore, in a bid to adhere to the by-laws, the members of the executive board had voted against Srivastava’s nomination. This also meant that he had to retire.   

Talking to City Spidey, Jain further added that now Srivastava was alleging that his retirement was wrongful. This, despite the fact that he had exercised voting rights to elect the members in the last election.
