Home buyers of Amrapali group housing projects in Noida and Greater Noida on Wednesday expressed strong objection to 'two clauses' of an official document they have been asked to sign before submitting the ownership papers of their flats with the court receiver R Venkataramani for verification. 

The buyers have also questioned the intention of Noida Industrial Development Authority. They complained that the authority sought an affidavit on non-judicial stamp which had several clauses mentioned and held objection against the clause no 3 and 4 and refused to the sign Form B of the document.

Joginder Singh, who had booked a flat in Amrapali Zodiac, a high-rise residential society in Sector 120, said that these clauses are against the buyers.      

He said, ''The authority have floated a notice along with the format of the affidavit and Form B, which are to be signed by the individual homebuyers while submitting ownership documents with the court receiver. We have urged all the homebuyers not to sign these legal document as they are against the interest of the homebuyers.''

As per the affidavit, Clause 3 said, deponent (individual homebuyer) will be responsible for any deficiency in documents/stamp for execution of Sub-Lease Deed of these flats and for paying the penalty for late execution of sub-lease deed as prescribed by Noida in accordance, with the terms and condition of the brochure/allotment /Lease Deed. 

The clause 4 read that the existing construction in the same dwelling unit is as per the sanctioned plan and no encroachment or commercial activity is there in these flats and no show cause notice or cancellation orders have been issued by the authority. in case, the same is found, the authority is free to cancel the allotment. 

Singh said, ''As these are highly defective and fix liability on homebuyers for certifying the layout plan which should be certified by authorities and it is their responsibility.''

''Also in Form B an undertaking from homebuyers is taken that they have given their consent to all revisions of layout plan which the builders had revised in connivance with authority without taking the consent of  the homebuyers.'' 

He said that all the homebuyers have been informed that they should not sign the documents and weaken their position. In fact, they should raise this issue through the lead petitioners in the supreme court on the next hearing.

Ravi Kant Srivastava, a homebuyer of  Amrapali Sapphire said, "We have put forth our objections on these clauses and urged R Venkataramani, the court receiver to make necessary changes as we are not aware whether the constructed building is as per the approved plan or not. The court receiver agreed to the suggested changes and the affidavit's format will be changed by the officials of Noida Authority.''
