Greater Noida: After waiting for possession from past three years, homebuyers of ATS Allure, a group housing project in Sector 22D, Yamuna Expressway Industrial Development Authority, Gautam Budh Nagar, have now lost their patience. They are planning to move the National Company Law Tribunal (NCLT) to get justice.

They informed that the project was launched in November 2013 with a promised completion by July 2017. The grace period was for next three months, which means the developer was supposed to give possession to them by October 2017. But it is still a distant dream for all those who booked homes in the project and made maximum payment to the developer.

A representative from the group of homebuyers said, “Now, we are in October 2020 and many of us already paid around 90 per cent of the price of the flat that was booked in the project. But we have still not received possession of the flats.”

In a recent meeting with the developer, homebuyers got shocked when they were told by the officials that the amount of money collected by selling inventories to homebuyers has already exhausted. Therefore, each homebuyer should pay the remaining amount to the developer for completion of the project, one of the homebuyers informed.

The official went ahead saying that the buyers should pay their remaining dues to the builder as advance. In return, ATS offered them a discount of Rs 50,000, which was rejected by the homebuyers present in the meeting.

They said that now, there is uncertainty around the fate of the project and the buyers are a worried lot. Some of them have gone to UP RERA, which ordered ATS to deliver the flats by March, 2021 and pay interest to buyers as compensation for delay in offering possession.

Homebuyers are now also planning to move NCLT because they have seen that in a majority of cases, UP RERA has also failed to get its order executed. The lesson for prospective home buyers is to go for ready to move in flats only, they said.
